To become a mercenary for a faction, you need to keep asking lords for tasks. If they offer you to join as a leader of a mercenary-troop, you may sign in. A faction needs to be at war before it starts looking for mercenary help. Hiring mercenaries in peacetime is a waste of money. Once you are a merc with a faction, though, I'm almost certain you can renew your contract as long as you please regardless of war. I don't think kings ever hire mercenaries, only lords.
In Warband if this happened your production just gets suspended, but it looks like you have to start from scratch in this game unacceptable. I'm a mercenary, it's not my fault if my ruler at the time decides to work against my interests, they should be responsible for compensating lost revenue due to this.
Contracts last until you cancel them, which can be done under the kingdom tab select 'leave kingdom' and you are free of your obligation to that kingdom.
